Well-known music critic and Chicago Sun-Times columnist Jim DeRogatis pled the First and Fifth Amendments of the US constitution—which cover freedom of speech and the right to non self-incrimination, respectively—in his refusal to answer questions during his appearance at R&B star R. Kelly’s sex tape trial. Among the questions DeRogatis refused to answer was whether or not he’d made a copy of the tape at the center of the trial—which he initially made public—constituting a criminal offense, according to lawyers for Kelly.
How did Derogatis—primarily known for his coverage and critique of indie/alternative rock bands—end up with the tape in the first place, anyway? Oh, right—that’s what he was supposed to divulge in court. Duh.
